Can settlement deed be challenged in court?
In 2018, Hindu, husband(age78) willingly executed a settlement deed, transferring ancestral property to his wife(age70).They have a son(age50) and a daughter(age45).The property acquired by husband as his father passed away when he was 2 years old. In 2023 Son has filed case against his mother that she forced her father to execute settlement deed to her name and as per law wife doesn't have share in ancestral property hence requesting court to cancel the settlement deed. Will court cancel it? Property is 50 sq.m , mother executed settlement deed of 25sq.m to daughter in 2023 and written will for other 25sq.m for her son. Will the court cancel the settlement deed acquired by mother from her husband?
