How can I deal with a neighbor taking up the common area parking spot daily?
I live in a housing society in Ahmedabad,Gujarat that was built in 2010.My society has 15 houses and our builder of the society also lives in 1 of the houses in my society. He has 4 cars and parks his 2 cars in common area of the housing society. Whenever any other resident of society parks their car in that common area parking spot, he says “This is My spot, nobody should park this car in My spot”. I told him that it is not his permanent parking spot and per RERA Act 2016,any member of the society can park his or her car in this common area parking spot but he is behaving like a bully and not allowing us to park our car there. He says that RERA Act was introduced in 2016 and he built this society in 2010 and hence any new RERA Act 2016 parking guidelines doesn't apply to this society. So I kindly ask what is the solution to this issue?
- Communicate with other residents, consider drafting a formal complaint addressed to the society’s management or chairman. Consult a legal expert. You can bring this to the notice of the Managing Committee. But you must also look at the society's Bye-Laws about parking in the common area. Every society has its own laws. If laws don’t say anything, then parking in the common area is allowed.
Sir, you need to file a police complaint regarding this matter followed by a complaint in your society committee. If nothing seems to be working you can also approach a lawyer for safeguarding your rights as a member of society. For further legal assistance contact us on our helpline number.
