Is a will without witnesses valid?

My father did a Registered Will in my name but later he cancelled the same registered will in Registrar office. However , there is no sign of one of the witness on the registered Cancelled will but there are thumb impressions of both witness on the back side of the document with Photo. Besides My younger brother also took possession of the house property and not allowing me to enter. if I file a Civil Partition case in court, Do I need to pay court fees (some % of property value) ? If Yes, in which circumstances this is refundable? I have two queries- Is this registered cancelled Will valid as it lacks sign of one witness.? In which circumstances, I can avoid this heavy court fess ?
