Tenant sublet the flat illegally, not handing over the keys

I rented out my flat in Bengaluru to a person in December 2021. Today, I got to know that he has sublet the flat via another person. This other person creates listings for other flats on Airbnb and when people contact him, he rents out my apartment. I have the entrance records, phone numbers, and photographs of the people who rented out the flat. Now, the tenant and the person have been issued notice via email to vacate the flat immediately (today) and hand over the keys to my representative (property manager). However, they are reluctant to do so and are making excuses. What can I do in this situation? Also, can my representative enter the flat and take possession with the extra key? I am also considering filing FIR / complaint but only when I get possession of the flat. Is this OK?

Hello sir, 

The property which you rented or leased  must have the rent agreement  does that rent agreement  have tenant transfer clause, if he had transfered there must be agreemnet for that and also there should be approval of the landlord, all laiblities to be duly paid duly signed by the parties.

But as per your query you were not notified therfore, you can can complain  for cheat and fraud against that person also you can send eviction notice to that particular give 30 days to vacate  the particular property.
