What are the powers of the apartment owners association?
Dear sir, I own a 3-BHK apartment in Bengaluru. The association is refusing to allow more than three students (in this case four students want to rent an apartment) in a 3-BHK by stating that their residents handbook issued in 2010 doesn't allow. They're refusing to complete the move-in formalities of the four students that have signed the lease agreement. Does the association have any right to impose this restriction as it violates the basic fundamental right of an Indian citizen? This restriction is valid only for students and not families. Please share your opinion and whether I could resort to legal action as the per-laws only stipulate that the owners should rent their apartments only for residential purposes. In this case, I am not violating any per-law.
