What can I do if tenant filed a false case and not giving rent?

The tenant occupied our flat in Jan. 2020, due to the COVID pandemic she said she doesn’t have money to pay and will pay it after it gets over, so as humans we understood her problem and said okay let it be she’ll give it afterwards. After 10 months we wanted to shift in our flat so we asked her to vacant it and pay us all the dues. Rather she said either you give me 50k or else I will file a case which she eventually did stating that she had been tortured and harassed during the covid time and wanted the court to let her stay in the flat. My father was the defendants in the case who passed away last year. What will happen now? Also we did file an eviction suit in the rent control authority just 6 months back, but don’t known how long will it take. This is frustrating as she has been staying there without paying rent and torturing us for more than 4 years now. Can we sell the flat with an ongoing case?

Your father's death doesn't automatically nullify the ongoing case against him. However, it does require notifying the court about his demise and appointing a legal heir to represent his side in the proceedings. contact us on our helpline number Consult a lawyer to understand the specific steps involved in this legal representation change.
