What if a seller won't return someone's earnest money?

An acquaintance entered into an agreement to buy a plot in kharar Punjab, the builder promised them a fully constructed house within short span of time and also provided service of facilitating a loan from Housing Finance company, Seller made them sign an sale agreement and recieved 4lakhs as earnest money, Things went bad when the buyer realised that the builder or the seller is a property dealer and not the real owner of th property also he had a nexus with Finance company too, No the buyer withdraw themselves from the loan and seller refuses to return earnest money. Legal Notices were sent, Police complaint was made, though Police took side of builder and harassed buyer, HFC returned the loan documents but 4lkahs is stuck with seller/builder. Need to get that back.

if the police is not taking action then you should approach to the Higher Authority such as Sp, Dsp and  magistrate to take action against person who cheated you or get a complaint drafted and send it to the concerned Magistrate of your area
