What if RERA order is not followed by builder?
Hi, 1. In July 23, RERA rejected the termination filed by builder and asked builder to pay interest till actual date of possession and settle of everything at the time of possession. 2. I followed up with builder for abiding the RERA orders, and giving me possession. 3. Builder sent demand, but not ready for follow RERA orders and not ready to settle off 4. Builder has appealed for both the cases recently 5. Now My question is, am i liable to pay him the demand now in this situation as well ? Legally can builder ask for demand even when they have filed appeal against RERA orders for cancellation of agreement/ flat? Two things are contradictory, 1 builder asking RERA to cancel the agreement and asking me to pay the demand Or should i be waiting for orders from appellate and later pay or settle off as per the order
An aggrieved party can file a complaint with the Regulatory Authority under Section 31 of the RERA Act.
You should wait for the orders from the appellate authority and then take further action as per the orders. Until then, you should not pay anything to the builder If the appellate authority upholds the RERA order, the builder will be obligated to deliver the property to you and pay you interest.
