What legal action can be taken if a person is refusing to comply with MOU?
We made MOU with notary for buying home and I gave 10 lakh to seller and total price of house is 13 lack, so only 3 lack was pending but after five years seller demand for extra amount or cancel the MOU, so please suggest
In your situation, the Memorandum of Understanding (MOU) serves as a binding agreement, and the seller cannot unilaterally demand additional payment or cancel it without valid grounds. Since you have already paid ₹10 lakh toward the total price of ₹13 lakh, you have a legitimate claim to the property. To address the seller's demand, respond formally. If they persist in their demands or attempt to cancel the agreement, consider seeking legal advice. You may need to file a suit for specific performance to enforce the MOU and protect your rights to the property.
Sir, if seller is demanding more money and refusing to comply with the said MOU, you have every right to file a suit for breach of trust/contract. We would suggest you to hire an expert lawyer who will guide you with the best course of action. For further legal assistance contact us on our helpline number.
