What legal steps can be taken against landlord?
Shop owner ask to evict shop in 1 month or pay 10k as rent from next month. We r paying 2.5k currently. NO RENT AGREEMENT was made. As my father was tenant from 20+ years. He died in Covid in 2021. From then I operate shop. He initially in 2021 agreed to pay rent with 500/- increase in every year. We also agreed. But now he said to pay 10k from next month or vacate Shop. We do clean shop area, painted every diwali, not a one garbage spread outside & our behavior is also good toward neighbour shop and house. He said pay rent as per market rate. But we can't bear 10k. We r mom-bro-me 3 member family. We agreed to pay rent upto 5k. But he not agreed. Saying pay 10k or vacate space. How to deal with this situation ? Please help me ? Waiting for your response
The landlord in Maharashtra cannot demand a hike to ₹10,000 rent without following the legal process. In any case, since you were your father's long-term tenant, there may be rights in this regard under the Maharashtra Rent Control Act. In general, unless major improvements have been done, the landlord can only raise the rent by a maximum of 4% per year. The proper eviction process requires a written notice with valid reasons. You can bargain for a reasonable amount of rent increase and consider taking legal advice if you feel that you are being unfairly treated as a tenant.
Negotiate with the shop owner and get an increase of ₹5,000 a month such that it is affordable to your family, and maintain records of communications done. As there is no rental agreement in writing and your father is a long-term tenant, you may have some rights under the local tenancy law; look up the proper Rent Control Act in your state, which normally guards the tenant against arbitrary hikes in rent. If the landlord still insists to evict you, then they will have to give a notice explaining the reason and sufficient days to vacate the property, usually 15 to 30 days. And hence, it is advisable to consult a lawyer specifically dealing with tenancy legislations to discuss your plight and ensure that your case is protected.
Sir, you have legal protections as a long-term tenant even without a formal agreement. You can also negotiate a reasonable rent increase and if necessary you may consider sending send a legal notice with the help of an expert lawyer who will assist you in understanding your rights to avoid unfair eviction and resolve the issue fairly.
