What legal steps can be taken to get your money back?
I booked two properties in outskirt of Bangalore. This site is panchayat Khata. It is not fall under BBMP. After booking, I gave property related documents to one of local lawyer he found that it is revenue site, No conversion, does not approved from BDA/BMRDA. When I show these documents to this group, they are not ready to give my booking money, they said they will deduct 30% as it is personal cancellation. During booking it is not mentioned anything about this. I don’t know what to do they are not returning my money at all.
In this situation, you may have grounds to demand a full refund of your booking amount. Since the properties were booked without clear disclosure about their status as revenue sites and lack of conversion or approval from BDA/BMRDA, the group may be liable for misrepresentation. Firstly, gather all documents, including the booking receipt and any correspondence with the seller. Send a formal written notice to the group, demanding the return of your booking amount without any deductions, citing the lack of proper disclosure regarding the properties. If they refuse to comply, consider seeking legal advice and filing a complaint with the Consumer Forum for redressal of your grievance.
The legal action if someone owes you money is to file a civil suit in a court of law or approach the debt recovery tribunal. You can also seek the help of a lawyer or debt recovery agent to recover the money.
Sir, you can send a legal notice based on the agreement you have signed with them demanding your money back if there was no such rule. For further legal assistance contact us on our helpline number.
