The application for transfer must be made to the court before the resolution of the issues between the parties in the case.Once the application for transfer has been submitted by one party, notice of this application should be sent to the opposing party.

As per your question, the petition for transfer of case is filed in High Court or Supreme Court, depending upon the case.

There should be valid grounds by the petitoners  for the transfer of the cae then only the case will be trnasfered.
