Punishment Of The Abettor When The Intention Is Different

IPC SECTION 110-INDIAN PENAL CODE-"PUNISHMENT OF THE ABETMENT IF PERSON ABETTED DOES ACT WITH DIFFERENT INTENTION FROM THAT OF ABETTOR"

Whoever abets the commission of an offence shall, if the person abetted does the act with a different intention or knowledge from that of the abettor, shall be punished with the punishment provided for the offense which would have been done had the act been done with the intention or knowledge of the abettor and not with any other.


Classification of the offence

Punishment—Same as offence—The offense abetted according to the offense is cognizable or non-cognizable—Bailable or non-bailable according to the offense—Triable by the court by which the offense is abetted—Non-compoundable.


Explanation

Through this section, we can understand that any person instigating on doing any of such offence which is illegal and is done of abetment with or without the same intention of the abettor, they would be considered with the same offence, and would have to face the same punishment.

Under this section, the punishment for the offence committed through the abetment is same.
