Abetment Of Offense By Public Or 10+ People

IPC SECTION 117-INDIAN PENAL CODE-"ABETTING COMMISSION OF OFFENCE BY THE PUBLIC OR BY MORE THAN TEN PERSONS"

Whoever generally or by any number or class of persons more than ten abets the commission of an offense shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both. will be punished.

Explanation

Under this section, we can understand that when a person tries to instigate more than 10 people to do any of the illegal offences would be held liable for the said offence. The idea behind this section is to control cast related conflicts, under this section the said punishment can extend to the term of 3 years or more and fine. India is a country with various cast and sects that can be triggered through the abetment of the abettors this needs to be checked in so this law is there to govern this type of activity.

Illustration-

A person has collected more than 10 people in a public area, intending to hurt the sect of other people. This case involves the abetment of instigating the group of members thus, the person organizing the attack would be held liable for the offence said in the section.

Classification of offence

Punishment- Imprisonment for more than 3 years and fine.

Bail-According, as offence abetted, is bailable or non-bailable.

Triable by the court by which offence abetted is triable-Non-compoundable.
