IPC Section 53A - Reference To The ‘Transportation' In Laws

IPC Section 53A states that - 

 

(1) As per the provisions of sub-section(2) & sub-section(3), all the references to the “transportation for life” in the different laws will be repealed. But, the references to the “transportation for life” must refer to the “imprisonment for life”.

 

(2) In every case in which the punishment of "transportation for a term" passed before the CrPC (Amendment) Act, the offender must be dealt with in the same manner as "sentenced to rigorous imprisonment".

 

(3) "Transportation for a term" or "transportation for a short term" shall have to be omitted.

 

(4) The term “transportation” in any other laws should be such that —

 

(a) all the references to the "transportation for life" in different laws should be treated as "imprisonment for life" ;

 

(b) "transportation for any shorter term" in the different laws must have to be omitted.
