IPC Section 73 - Solitary Confinement Of Offenders

IPC Section 73 states that - any person who is convicted for an offence such that the court has the power to punish the offender for rigorous imprisonment then, the court can pass the order to keep the offender in solitary confinement for a certain term.

 

Solitary Confinement - Solitary confinement is a form of confinement in which the prisoners are kept in a single cell with no contact with other prisoners & stop the use of substances like drugs or, narcotic products. 

 

The offender shall be kept in solitary confinement such that - 

 

  1. If the imprisonment is not exceeding 6 months, the punishment of solitary confinement  shall not exceed 1 month
  2. If the imprisonment exceeds 6 months but does not exceed 1 year, the punishment of solitary confinement shall not exceed 2 months.
  3. If the imprisonment exceeds 1 year, the punishment of solitary confinement shall not exceed 3 months.
