IPC Section 89 - Act Done In Good Faith Without Guardian's Consent

IPC Section 89 states that - 

 

All the actions that are taken by a person in good faith:

  • For the benefit of a person whose age is less than twelve years old
  • For the benefit of an unsound mind person
  • By the consent of the person ( Either expressed or implied)

 

Conditions - 

 

a) that this exception must not extend to the intentions that can cause death or attempt to cause death;

 

b) that this exception should not extend to the doing of any act which the person knows that for any purpose other than preventing/stopping death or serious, that can cause death injury or the treatment of any serious disease or infirmity.

 

 

c) that this exception shall not extend to abetment to the commission of an offence.
