IPC Section 90 - Consent Given Under Fear Or Misconception

IPC Section 90 states that - 

 

Consent is not said to be consent as per this Indian Penal Code If:

 

  • Consent is given by a person due to the fear of injury
  • Consent is given by a person due to the mistake of fact
  • Consent is given by the person who knows or who has the reason to believe that consent is given due to fear of injury or mistake of fact
  • Consent Of Insane Person - Consent is given by a person (unsound mind or intoxication) who is unable to understand the nature & consequence of that consent
  • Consent Of Child - Consent given by the person whose age is less than 12 years old.
