IPC Section 98 states that -
Every person has the same right to private defence of person & property in these cases:
1) act of a person due to immaturity of understanding
2) act done by an unsound minded person
3) act done by an intoxicated person
Even if it is not an offence, anyone can use their right for the private defence of a person & property.
