Power To Transfer Petition In Certain Cases

It is possible to transfer the petitions from one court to the other in certain situations - 

1) If a partner files a petition for judicial separation  ( Under Section 10 ) or, Divorce ( Under Section 13) in a district court

2) The other partner also files the petition for judicial separation or divorce in the same district court or different district courts

This can be handled in two different ways - 

a) If both the petitions are filed in the same district court, there will be no transfer of petitions.

b) If both the petitions are filed in the different district courts, the petition will be transferred to the district court in which the petition has been filed earlier.
