I want to divorce my wife, but she is unwilling to agree to it. Her family is only concerned about the property. They repeatedly visit our house, threaten me, and use abusive language against my wife. Because of their behaviour, I had to leave my home and stay away from my parents for two years. When I returned, they started behaving the same way again. I would like to know what legal options are available to me.
You can file a contested divorce petition in the Family Court even if your wife does not agree to the divorce. If you are Hindu, cruelty may be a legal ground under Section 13(1)(ia) of the Hindu Marriage Act, 1955, depending on the evidence. Keep evidence of threats, abusive messages, calls, property disputes, and witness details. Report threats to the police if necessary and consult a family lawyer to assess your case and seek protection. For further legal assistance contact us on our helpline number.
